Terms of Service
These Terms govern your access to and use of FISTY, including the FISTY website, web app, mobile applications, live rooms, reactions, creator features, commerce features, and related services.
1. Agreement to these Terms
By creating an account, continuing through an account sign-up flow, joining or hosting a room, making a purchase, publishing content, or otherwise using FISTY, you agree to these Terms and our Privacy Policy, Community Guidelines, Copyright Policy, and Data Choices information.
If you do not agree, do not create an account or use features that require acceptance of these Terms.
2. Eligibility and accounts
FISTY accounts are currently intended for adults age 18 or older unless FISTY expressly enables another age-specific account experience in your location.
- You must provide accurate account information.
- You are responsible for activity under your account.
- Do not share authentication credentials with another person.
- You may not impersonate another person or organization.
- You must comply with applicable law when using FISTY.
3. What FISTY provides
FISTY is a social watch-and-react platform where people can discover content, join rooms, watch together, react with camera or video, chat, share links or products, create moments, host experiences, and use creator and commerce tools.
Features may differ by platform, browser, device, account status, location, provider availability, subscription, or technical capability.
4. Rooms, cameras, reactions, and shared experiences
When you join a FISTY room, your participation may include live camera, microphone, reactions, messages, shared links, products, screen content, or other room activity depending on the features you choose to enable.
Public rooms may be visible or discoverable by other users. Private rooms may require an invitation, room authorization, or other access control. You are responsible for understanding the visibility of a room before sharing personal information or content.
FISTY may provide tools such as Step In, lenses, background removal, overlays, synchronized playback, live reactions, and shared-room media. You are responsible for using those tools lawfully and respectfully.
5. Your content
You retain ownership of content you create and own. You grant FISTY a non-exclusive, worldwide license to host, store, process, reproduce, display, transmit, adapt for technical delivery, and distribute your content only as reasonably necessary to operate, secure, improve, and provide the FISTY service and the audience or visibility settings you choose.
This license ends when your content is deleted from FISTY systems, except where retention is reasonably necessary for backups, security, legal compliance, dispute resolution, or content already shared by others in a way permitted by the service.
You represent that you have the rights and permissions necessary to upload, stream, publish, or share your content through FISTY.
6. Third-party content and services
FISTY may help users bring third-party videos, websites, products, streaming services, places, or other content into a shared experience. Third-party services are governed by their own terms, licenses, privacy policies, and availability rules.
FISTY does not give you rights to copy, rebroadcast, publicly perform, distribute, or commercialize third-party content beyond rights you independently possess.
7. Creator features, purchases, and commerce
FISTY may offer creator tools, paid rooms, subscriptions, gifts, tips, promotions, products, affiliate links, shopping experiences, or other paid features.
- Prices and applicable fees are shown before purchase when available.
- Payment processing may be performed by third-party payment providers.
- Creators are responsible for their own taxes, disclosures, and legal obligations.
- Physical goods may be sold or fulfilled by third-party sellers.
- FISTY may suspend commerce features to prevent fraud, abuse, or legal risk.
8. Prohibited conduct
You may not use FISTY to:
- Threaten, harass, exploit, stalk, or abuse another person.
- Publish illegal, fraudulent, deceptive, or infringing content.
- Sexually exploit or endanger minors.
- Attempt unauthorized access to accounts, rooms, systems, or data.
- Distribute malware, spam, scams, phishing, or malicious code.
- Manipulate engagement, identity, ratings, reviews, or commerce activity fraudulently.
- Evade bans, access controls, security measures, or moderation actions.
- Use FISTY in a way that violates the rights of others or applicable law.

9. Moderation and enforcement
FISTY may remove or restrict content, limit distribution, disable features, lock rooms, suspend accounts, terminate accounts, or take other reasonable action when necessary to enforce these Terms, protect users, respond to legal requirements, or protect the security and integrity of the service.
10. Copyright and intellectual property
Respect intellectual property rights. If you believe content on FISTY infringes your copyright, follow the process described in our Copyright Policy.
FISTY trademarks, branding, software, interface elements, and other FISTY materials are owned by or licensed to FISTY and may not be copied or used except as permitted by law or written authorization.
11. Privacy and data controls
Our Privacy Policy explains how information is collected, used, disclosed, protected, and retained. Our Data Choices page explains available controls for privacy, communications, account information, and related requests.
12. Service changes and availability
FISTY may add, modify, suspend, or discontinue features. We do not promise that every feature, provider, stream, room, integration, or third-party service will always be available or uninterrupted.
13. Disclaimers
To the maximum extent permitted by law, FISTY is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted operation, error-free service, specific audience results, creator earnings, product authenticity, third-party availability, or that user-generated content will always be accurate or appropriate.
14. Limitation of liability
To the maximum extent permitted by applicable law, FISTY and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, business opportunities, or other intangible losses arising from use of the service.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
15. Your responsibility to FISTY
To the extent permitted by law, you are responsible for claims, losses, or expenses arising from your unlawful use of FISTY, your content, or your violation of these Terms or another person's rights.
16. Account suspension or termination
You may stop using FISTY at any time. Where account deletion tools are available, you may request deletion through your account or applicable privacy process.
FISTY may suspend or terminate access when reasonably necessary for safety, legal compliance, fraud prevention, repeated violations, or protection of the service and its users.
17. Changes to these Terms
We may update these Terms as FISTY evolves. When changes are material, we may provide notice through the service or require renewed acceptance. The effective date above identifies the current version.
